Donald Schroeder Quoted on Gig Economy Collective Bargaining Challenges
Â鶹´«Ă˝ partner Donald Schroeder was quoted in Law360’s article, “,” addressing the challenges of applying collective bargaining to the gig economy.
Schroeder emphasized that both sides may struggle to translate the gig economy’s flexible structure. He added that “gig work is defined by its flexibility, allowing drivers and other workers to decide when and where to work. A contract defining terms for that work contradicts that structure.”
“The more contractual requirements that are imposed upon the employer, and therefore imposed upon independent contractors, the less flexibility they have,” Schroeder said.
He also cautioned about the potential implications for drivers, noting, “I’m not sure the drivers know what they’re getting themselves into, and what this would generally look like beyond the money.”
