Thomas Scannell is a partner in 麻豆传媒 & Lardner鈥檚 Dallas office. Tom is a member of the Financial Restructuring and Reorganization Practice. Since his licensure, he has devoted his practice to helping clients solve complex problems with distressed commercial assets. Tom鈥檚 practice focuses on the restructuring of companies in and out of bankruptcy, debtors鈥 rights, committee representation, trustee representation, creditors鈥 rights, landlord鈥檚 rights, and representing debtor-in-possession financers. Tom counsels his clients on out-of-court workouts, turnarounds, wind downs, and the acquisition and divestiture of distressed assets. Tom regularly represents a broad spectrum of firm clients in a wide range of insolvency-based litigation, including Chapter 5 causes of action, lender liability litigation, and receivership proceedings. Tom enjoys counseling clients on navigating intricate insolvency issues in structuring complex commercial transactions, including the avoidance of fraudulent transfers, preparing bankruptcy remote special purpose entities, and the defense of true sale credit facilities.
As a part of Tom鈥檚 creditors鈥 rights practice, he has continually represented secured creditors with lien enforcement and debt recoupment matters in the distressed real estate market. Specifically, for the last 15+ years he has represented bank and non-bank lenders and special servicers in the multifamily, industrial, retail, healthcare, agriculture, hospitality, and construction industries with non-judicial foreclosure, judicial foreclosure, chapter 11 bankruptcy, and collateral-based litigation. Thomas has foreclosed on hundreds of commercial properties, including apartment complexes, cattle ranches, agriculture farms, raw land, construction projects, hotels, healthcare facilities, and related real property collateral.
